TERMS AND CONDITIONS OF ENTRY INTO "HCF 2025 SSN Grand Final" PROMOTION

  1. Information on how to enter and prize details form part of these conditions. By entering into this Promotion you acknowledge that you have read these terms and conditions of entry and agree to be bound by them. If you are aged between 13-17, your parent/guardian acknowledges that they have read these terms and conditions of entry and agrees to be bound by them as if they were an Eligible Entrant.
  2. The Promoter is The Hospitals Contribution Fund of Australia Limited (ABN 68 000 026 746) of 403 George Street Sydney NSW 2000 ("Promoter"). To contact the Promoter, please call 1300 363 992.
  3. The “HCF 2025 SSN Grand Final Promotion” (Promotion) commences at 8:00am AEDT on Friday 04 April 2025 and ends at 11:59pm AEST on Sunday 13 July 2025 ("Promotion Period"). The Promoter reserves the right to amend the Promotion end date, draw date, notification of winner date and publication of winner name date at any time (subject to regulatory approval) by providing reasonable notice to entrants.
  4. Entry is only open to residents of Australia who are aged 13 years and over, have a valid telephone number and valid email address, have permission from their parent or guardian to enter if they are aged between 13-17, and are not a person described in clause 5 (“Eligible Entrants”). Where applicable, Eligible Entrants will be required to provide proof of eligibility to redeem their prize.
  5. Employees (and their immediate family members) of HCF and agencies associated with this Promotion are ineligible to enter the Promotion. An ‘immediate family member’ includes any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  6. To enter and be eligible to win, an Eligible Entrant must, during the Promotional Period go to the Promotion website at https://enter.hcfteamhealthscore.com.au and complete the HCF Team Health Score game and entry form (Entry Form) providing:
    1. their first name, surname, email address, mobile phone number, postcode and age;
    2. the Super Netball team they support;
    3. if they are between 13-17 years of age, that they have received their parent's or guardian's permission to enter the promotion, and the first name, surname, email address and mobile phone number of that parent or guardian; and
    4. acceptance of these terms and conditions or if they are 13-17 years of age, that their parent or guardian accepts these terms and conditions.
  7. The HCF Team Health Score game comprises three digital games, which Eligible Entrants must complete and receive a final 'score' in order to enter the Promotion (along with the completion of the Entry Form).
  8. Entries will be deemed accepted at the time of receipt by the Promoter. Entries received will be considered final by the Promoter. No late entries will be accepted. There is no cost to enter the Promotion.
  9. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
  10. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period, unless the entry has not been received because of the Promoter's negligence or breach of these terms and conditions.
  11. Incomplete, illegible and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win.
  12. The prize pool consists of 1 Major Prize and 14 Minor Prizes.
    1. The Major Prize consists of:
      1. 4x reserved seating tickets to the 2025 Super Netball Grand Final (Grand Final) to be held in Melbourne, Victoria on Saturday 2 August 2025, valued at AUD $360 incl. GST per ticket;
      2. 4x tickets to the Super Netball Grand Final Lunch to be held in Melbourne, Victoria on Saturday 2 August 2025, valued at AUD $1,996 incl. GST;
      3. If the winner of the Major Prize (Major Winner) resides outside of Victoria, 4x return economy flights to Melbourne, Victoria from the Major Winner’s nearest capital city with an airline and at the dates and times chosen by the Promoter, valued at up to AUD $2,500 incl. GST depending on the residence of the Major Winner. Should the Major Winner reside in Victoria this prize item will not be substituted; and
      4. 2x twin share accommodation for 2 nights at a hotel in Melbourne, Victoria chosen by the Promoter of at least 3 stars, valued at AUD $1,000 incl. GST;
    2. The Minor Prizes consist of:
      1. 7x Corporate hospitality Super Netball game family passes (4x tickets per pass) to see the Super Netball team selected on the winner's Entry Form i.e. Queensland Firebirds, Sunshine Coast Lightning, NSW Swifts, GIANTS Netball, Melbourne Vixens, Adelaide Thunderbirds, West Coast Fever, see values for ticketing per club below (First Minor Prize). One First Minor Prize per team to be won.

          1. GIANTS Netball v Melbourne Vixens, Sunday, June 1, 2025, valued at AUD $200 incl. GST per ticket
          2. NSW Swifts v West Coast Fever, Saturday, June 7, 2025, valued at AUD $250 incl. GST per ticket
          3. Sunshine Coast Lightning v Melbourne Vixens, Saturday, June 21, 2025, valued at AUD $214.50 incl. GST per ticket
          4. Queensland Firebirds v Melbourne Mavericks, Sunday, June 22, 2025, valued at AUD $125 incl. GST per ticket
          5. Melbourne Vixens v Queensland Firebirds, Sunday, July 6, 2025, valued at AUD $280 incl. GST per ticket
          6. West Coast Fever v GIANTS Netball, Sunday, July 6, 2025, valued at AUD $370 incl. GST per ticket
          7. Adelaide Thunderbirds v Sunshine Coast Lightning, Saturday, July 12, 2025, valued at $220 incl. GST per ticket
      2. 7x merchandise vouchers for the Super Netball team selected on the winner's Entry Form i.e. Queensland Firebirds, Sunshine Coast Lightning, NSW Swifts, GIANTS Netball, Melbourne Vixens, Adelaide Thunderbirds, West Coast Fever, valued at AUD $200 incl. GST per voucher (Second Minor Prize). One Second Minor Prize per team to be won.
  13. The total prize pool value is AUD [$14,974.00] incl. GST as at the publishing date of these terms and conditions.
  14. Other than the costs set out in clause 12.a(iii.), the Prize does not include any costs associated with redeeming the Prize including the cost of travel from the Major Winner's home to the airport, to the Grand Final Lunch and Grand Final match, or to the Super Netball games of the choice of the winners of the First Minor Prize.
  15. Spending money for incidental expenses is not included in the Prizes. Travel insurance is not included in the Prizes. The Promoter strongly recommends that travel insurance is purchased by the Major Winner before travel. The Promoter makes no representation as to the safety, conditions or other issues that may exist in transit or at any destination.
  16. If any of the Prizes (or any portion of the Major Prize) are not available for any reason, the Promoter reserves the right to substitute the relevant Prize with another similar item of equal or greater value if the relevant Winner agrees in writing and subject to any approvals from regulatory authorities. If the Winner does not agree despite reasonable attempts by the Promoter to reach an agreement and the relevant Prize (or portion of the Prize) is not available due to circumstances beyond the Promoter's control, the Promoter may substitute it with another item or items determined by the Promoter to be similar and of equal or higher value.
  17. None of the Prizes, or any unused portion of the Major Prize, can be exchanged or redeemed for cash, returned for a refund, or transferred to any other person.
  18. The Minor Winners will be chosen at random by manual draw. The draws for the 7 x First Minor Prizes will take place at 10:00AM AEST on Monday 12 May 2025 at the Promoter’s premises, being 403 George Street Sydney NSW 2000. All entries received by 11:59pm AEST on 11 May 2025 will be pooled into 7 separate draws based on the Super Netball team selected on the Entrants' Entry Forms. The first entry drawn from each of the 7 pooled entries will win the First Minor Prize for the Super Netball team selected on the winner's Entry Form. This means that the seven First Minor Prizes will be awarded to supporters of the seven Super Netball teams. The draws for the 7 x Second Minor Prizes will take place at 10:00AM AEST on Monday 16 June 2025 at the Promoter's premises (Second Minor Prize Draw). All entries received by 11:59pm AEST on 15 June 2025 including the non-winning entries from the First Minor Prize Draw will be pooled into 7 separate draws based on the Super Netball team selected on the Entrants' Entry Forms. The first entry drawn from each of the 7 pooled entries will win the Second Minor Prize for the Super Netball team selected on the winner's Entry Form. This means that the seven Second Minor Prizes will be awarded to supporters of the seven Super Netball teams.
  19. The Entrant with the highest HCF Team Health Score as noted on the HCF Team Health Score game will be the Major Winner. Where there are equal highest scores, the Major Winner will be chosen by manual draw of the Entrants with the equal highest HCF Team Health Score. This will be confirmed or drawn at 10:00am AEST on Monday 14 July 2025 at the Promoter’s premises, being 403 George Street Sydney NSW 2000.
  20. The names (surnames and first initials) and postcodes of the Major Winner and the winners of the First Minor Prizes and Second Minor Prizes (Minor Winners) will be published at https://www.hcf.com.au/netball within 24 hours of the relevant draw. The Promoter will take all reasonable steps to contact the Major Winner and Minor Winners as set out below in clause 22. Wherever there is a reference in these terms and conditions to HCF contacting or notifying the relevant winner(s), that reference should be read as HCF contacting the relevant winner's parent or guardian using the details provided on the Entry Form, if the winner is aged 13-17.
  21. The Promoter's decision (including any decisions as to Prize distributions) is final and the Promoter will not enter into correspondence regarding the results.
  22. The Major Winner will be notified by phone and in writing (email) using the details provided on the Entry Form no later than Friday 18 July 2025. The Minor Winners of the First Minor Prizes will be notified by phone and in writing (email) using the details provided on the Entry Form no later than Wednesday 14 May 2025, and the Minor Winners of the Second Minor Prizes will be notified by phone and in writing (email) using the details provided on the Entry Form no later than Wednesday 18 June 2025. To claim the relevant Prize, the relevant Winner (or their parent or guardian if the Winner is aged 13-17) must respond in writing (email) that they accept the Prize.
  23. The Promoter must distribute the relevant Prize to each relevant Winner within 10 days of the relevant draw.
  24. If the Major Winner (or their parent/guardian, if applicable) does not respond within five days of being notified that they have won the Major Prize or has responded that they do not accept the Major Prize, the Major Winner is not readily identified and reasonable attempts have been made by the Promoter to contact the Major Winner, the Major Winner that has not claimed their Major Prize will automatically forfeit their prize and the Promoter reserves the right to select another major winner through a second chance draw.
  25. If necessary, an unclaimed prize draw for the Major Prize will occur on Thursday 23 July 2025 at the same time and address as the original draw. The Entrant with the second highest HCF Team Health Score as noted on the HCF Team Health Score game will win the unclaimed Major Prize or where there were equal highest scores, the new major winner will be chosen by manual draw of the remaining Entrants with the equal highest HCF Team Health Score.
  26. The unclaimed Major Prize winner will be notified in writing (by email) within 2 business days and their name (surname and first initial) and postcode will be published at https://www.hcf.com.au/netball by Friday 25 July 2025.
  27. If the Minor Winner (or their parent/guardian, if applicable) does not respond within one week of being notified that they have won a Minor Prize or has responded that they do not accept the Prize, the Minor Winner is not readily identified and reasonable attempts have been made by the Promoter to contact the Minor Winner, the Minor Winner that has not claimed their Prize will automatically forfeit their prize and the Promoter reserves the right to select another minor winner through a second chance draw.
  28. If necessary, an unclaimed prize draw for a Minor Prize will occur on Monday 26 May 2025 in relation to a First Minor Prize, or on Monday 30 June 2025 in relation to a Second Minor Prize, at the same time and address as the relevant original draw. The first valid entry drawn from the pool of entries for the Super Netball team selected by the unclaimed winner, will win the relevant unclaimed Minor Prize.
  29. The unclaimed Minor Prize winner will be notified in writing (by email) within 2 business days and their name (surname and first initial) and postcode will be published at https://www.hcf.com.au/netball by Wednesday 28 May 2025 in relation to a First Minor Prize, or by Wednesday 2 July 2025 in relation to a Second Minor Prize.
  30. The results of any unclaimed prize draw will be final and binding and no correspondence will be entered into in relation to the results of the draw. The Promoter must distribute the Major Prize to the unclaimed prize winner within three days of the selection / draw and must distribute the Minor Prize to the unclaimed prize winner within 10 days of the draw.
  31. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of HCF, including but not limited to technical difficulties, unauthorised intervention or fraud, HCF reserves the right, in its sole discretion, to the fullest extent permitted by law (including the Australian Consumer Law):
    1. to disqualify any individual; or
    2. to modify, suspend, terminate or cancel the Promotion, as appropriate, subject to regulatory approval.
  32. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees").
  33. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, HCF (including its respective officers, employees and agents) is not responsible for and excludes all liability for any loss or damage that you may suffer in connection with accepting, redeeming or using any of the prizes, except to the extent the loss or damage is caused by HCF's negligence or breach of these terms and conditions.
  34. HCF (including its respective officers, employees and agents) is not responsible for and excludes all liability for indirect or consequential loss or damage that you may suffer in connection with this Promotion or use of the Prize, including loss of opportunity, loss of profit, personal injury or property damage.
  35. The Promoter collects personal information ("PI") in order to conduct this Promotion and comply with its legal obligations as the Promoter and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. If you do not provide (or HCF cannot otherwise collect) all of the PI requested, you will not be eligible to receive the Major Prize. Submitting an entry is also conditional on providing this PI. The Promoter will also handle PI collected as part of the Promotion in accordance with its Privacy Policy, which can be viewed at https://www.hcf.com.au/privacy-policy/. The Privacy Policy also contains information about how you may opt out, access, update or correct your PI, how you may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
  36. By entering into the Promotion, the Entrant agrees and acknowledges that:
    1. they may be contacted by the Promoter to provide comments about the Promotion and the Promoter (or an agent of the Promoter) may take photos and video of them and collect comments from them on the day the relevant Prize is awarded or while participating in a Prize, without remuneration. References to comments about the Promotion, photos, videos and entry details are collectively, the "Materials";
    2. they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable license to use the Materials for the purposes of marketing the Promotion and the Promotor, including on the Promotor's social media sites;
    3. they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");
    4. they waive all Moral Rights in the Materials that arise outside Australia; and
    5. they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
  37. The Promoter accepts no responsibility for any tax liabilities that may arise from winning the Prize, including fringe benefits tax. Independent financial advice should be sought.
  38. The laws of New South Wales apply to this Promotion. Entrants submit to the exclusive jurisdiction of the courts of New South Wales.
